Our Terms of Service

1. Service Frequency and Fees:


The POOLice Pool Service & Maintenance will provide pool service once a week at the Customer’s address. Customer agrees to pay a monthly pool service fee in advance each month for the service.

The Parties agree that circumstances can arise that affect or prevent The POOLice Pool Service & Maintenance from performing pool and/or spa maintenance such as the weather, an illness, or a holiday.

 In such event, The POOLice Pool Service & Maintenance may elect to postpone pool
and spa service for one week, not to exceed 2 weeks each year. However, in no event shall pool and spa service be provided during the weeks of Thanksgiving and Christmas.
 

In the event of inclement weather on the scheduled date of service, the pool and spa will be cleaned to the
extent weather permits and only chemicals will be added.
 

Customer must ensure The POOLice Pool Service & Maintenance has access to the service area on the scheduled service day, including gate entry
codes, lock combinations, security guard verification, and pets relocated from pool/spa area.

If The POOLice Pool Service & Maintenance is
unable to access the service area for any reason, services will not be performed that week and Customer shall not be entitled to a credit.
 

Vacation/Holidays:


The POOLice Pool Service & Maintenance will be closed, and service will not be provided as follows:

1. Thanksgiving week, and

2. Christmas week
 
These dates are already accounted for in calculating the monthly service fee.

Therefore, no credit is due.

In the event of an emergency, The POOLice Pool Service & Maintenance will make every effort to return your calls and answer emails.
Emergency services are provided at a separate agreed upon rate quoted on a case-by-case basis.
 

2. Services:


 The POOLice Pool Service & Maintenance shall provide the following services each week:
• Pool vacuumed as needed
• Pool surface skimmed as needed
• Filter air relieve as needed
• Leak baskets cleaned
• Pump baskets cleaned
• Pool equipment operation inspected
• Pool walls, floor, and tile to be brushed
  as needed
• Water tested and balanced each week
 

Customer is responsible for water levels during the week.


Recommended water level is MID-TILE.

 Following chemicals used during weekly service are included in the monthly service fee (Muriatic Acid, Liquid Chlorine (in the summertime Pool Shock and Trychlor Tablets).

 Not included are Pool Conditioner (we charge $50 per Gallon) and Phosphate remover ($100 Per Gallon)!

Filter cleaning is NOT included in the monthly service and have to be cleaned every 3 months, unless extra service is required (after a severe Sandstorm). Filters MUST be properly maintained for The POOLice Pool Service & Maintenance to perform proper maintenance service we take no responsibility for damages or algae in your pool without prober Filter cleaning schedules.

All standard service is billed at a rate of ½ hour,
and any additional labor charges will be billed at a rate of $20 per each additional 15 mins. For example, Storm Cleanup, Excessive Debris, and any other situations out of the normal scope of work for your swimming pool.

 

3. Repairs:


Repairs are not included in the monthly service fee. Repairs under $50 will be performed
immediately and charged separately to the Customer. Repairs greater than $50 shall require Customer authorization in advance of the repair.
 

4. Service calls: 
 

For our existing customers we charge $50 for service calls.

Non existing customers, we charge $150 for service calls.


5. Pricing:

 

Customer agrees to pay The POOLice Pool Service & Maintenance the monthly service fee stated above as well as any additional costs that may be incurred for repairs or services that are in addition to the services specified in paragraph 2 above.

Additionally, Customer shall incur an additional charge of $100.00 every 4 months (or when necessary) for filter cleaning and additional $80 for Salt cell cleaning three times a year.
 
6. Payment:

 

The POOLice Pool Service & Maintenance accepts Zelle to poolicepoolservice@gmail.com (Kaerntner King Food LLC) and autopayments to:

 Routing number: 322271627, Account number: 771221527

We also use Venmo, Cash app and Credit cards (3.6% fee)

Each monthly payment must be received by The POOLice Pool Service & Maintenance, in full, before the FIRST scheduled service for that month.

For example, the monthly payment for October service must be received by The POOLice Pool Service & Maintenance before Customer’s first scheduled service for October.
If the payment does not arrive in time any additional charges that may
become due and payable, Customer shall be in default.

In the event of default, services will be postponed, and Customer will assess a late fee penalty of $30.

If Customer fails to cure the default, the Parties agree that The POOLice Pool service & Maintenance shall suffer liquidated damages as a result of the Customer’s default in the amount of $30 per month.

Customer agrees that the liquidated damages are in addition to the monthly service fee that remains due and payable and are intended to compensate The POOLice Pool Service & Maintenance for damages suffered as a result of the inability of The POOLice Pool Service & Maintenance to anticipate Customer’s default and immediately fill the void created by the default with a new customer.
 
7. Warranty Claims:


Here at The POOLice Pool Service & Maintenance, we strive to get our customers the right product, the first time. Even though we aim for this, mistakes do happen.  The POOLice Pool Service & Maintenance has built its reputation on trust. We stand by the quality of our craftsmanship and provide you with a 6-month Warranty for all installations done on your pool (excludes Pool equipment like Heaters, Pumps, Automation or all parts from a third party excludes Internet buys).


Manufacturers have their own Warranty regulations therefore we don’t do warranty repairs it’s your responsibility to register the installed product on the manufacturers website and file a warranty claim directly with the Manufacturer. When you buy equipment from the Internet most of the Manufacturer’s only give you a 60 Day Warranty.

In the rare event for a warranty claim you have to pay The POOLice Pool Service & Maintenance for there work in full and claim the warranty by yourself.


If you need to call in for a warranty, be sure to have your original receipt of purchase and installation as well as the installation date and the product serial numbers. You then have to call the equipment manufacturer to call in a warranty claim. They will ask for all of those items before they can assign the claim to an authorized warranty service center.


8. Disclaimer:

 

The POOLice Pool Service & Maintenance shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals, sunlight, and, in some cases, other corrosive materials (i.e., salt).

The CUSTOMER is responsible for always maintaining correct water level.

Also, The POOLice Pool Service & Maintenance is not responsible
for any damages or deterioration caused by failure of a customer to perform other services recommended by The POOLice Pool Service & Maintenance, or by failure of Customer to properly maintain pool and equipment between visits.

 

 9. Termination:

The Parties agree that this Agreement is a monthly service agreement that continues from
month to month until terminated. The Agreement may be terminated by either Party. However, the Parties
further agree that Customer shall give The POOLice Pool Service & Maintenance two weeks advance written notice of Customer’s termination of this Pool Service Agreement.

Such written notice may be delivered, by email to poolicepoolservice@gmail.com, or text message to 702-722-8558.
 
 

10. Mediation:

 The Parties agree that any future disputes between them arising under this Agreement shall be submitted to a half day mediation before a former or retired Clark County District Judge or an agreed upon mediator.

This Agreement shall be construed and is governed under the laws of the State of Nevada.
